Abstract

Considerando que, desde 2017, a Corte Interamericana de Direitos Humanos consolidou a possibilidade de justiciabilidade direta dos Direitos Econômicos, Sociais, Culturais e Ambientais por meio do artigo 26 da Convenção Americana sobre Direitos Humanos, incluindo o direito à seguridade social, o presente artigo possui como foco investigar os standards mínimos fixados pelo Tribunal Interamericano concernente a este direito. Nessa perspectiva, objetiva-se responder à seguinte problemática: quais são os standards mínimos fixados pela Corte Interamericana de Direitos Humanos em matéria de seguridade social? Para tanto, adotam-se o método de abordagem dedutivo e o procedimento analítico, além de recorrer às técnicas de pesquisa bibliográfica e jurisprudencial. Infere-se que existem 4 (quatro) casos julgados pelo Tribunal Interamericano em matéria de seguridade social, nos quais foram delineados os seguintes standards: direito ao acesso à pensão; valor e duração adequados dos benefícios; respeito aos princípios de disponibilidade e acessibilidade; cobertura de riscos e contingências sociais; benefícios em nível suficiente; pontualidade nos pagamentos; mecanismos de contestação e acesso à justiça; e contribuição do direito à seguridade social para o fortalecimento do exercício dos demais Direitos Econômicos, Sociais, Culturais e Ambientais.
