Abstract

A pesquisa realizada tem como escopo principal aprofundar os estudos e discussões acerca da influência democrática na aplicação da lei penal, bem como fomentar o exercício do pensamento crítico na visualização da enorme distância entre teoria e prática, situada, especificamente, na prática delitiva e no emprego das punições estatais, confrontando a realidade da aplicação da lei penal com os princípios basilares da democracia presentes na Constituição Federal.PALAVRAS-CHAVE: Democracia. Cidadania. Estado Democrático de Direito.
