PELANGGARAN KEKAYAAN INTELEKTUAL DALAM CLOUD COMPUTING

Abstract

Komputasi awan sebagai salah satu perkembangan teknologi informasi telah membentuk dasar infrastruktur untuk penyimpanan data berbasis internet. Meskipun penting untuk mengembangkan infrastruktur tersebut, aspek keamanan dalam komputasi awan menjadi aspek yang wajib diperhatikan. Data yang disimpan dalam komputasi awan seringkali tunduk pada hak kekayaan intelektual sehingga perlindungan dan keamanannya harus dijamin. Berkaitan dengan hal ini, persoalan terkait dengan bentuk-bentuk pelanggaran hak kekayaan intelektual dalam komputasi awan dan aspek yurisdiksi hukum dalam pelanggaran hak cipta dalam komputasi awan dibahas dalam penelitian ini. Dalam mengumpulkan data, metode yang digunakan adalah yuridis normatif dan dipaparkan secara deskriptif analitis. Data penelitian dikumpulkan melalui studi kepustakaan terhadap data sekunder. Data yang terkumpul kemudian dianalisis dengan metode analisis yuridis kualitatif. Seperti disrupsi teknologi besar lainnya, pergeseran ke komputasi awan tidak akan sepenuhnya bebas dari hambatan hukum, di mana pelanggaran hak kekayaan intelektual dapat terjadi dalam hal berkurangnya akses, kontrol, dan perlindungan atas ide, serta meningkatnya pembajakan ciptaan dan serangan keamanan pada server yang dilakukan oleh pihak yang tidak bertanggung jawab. Pelanggaran hak kekayaan intelektual yang terjadi dalam komputasi awan dapat melibatkan pengguna dan penyedia layanan. Pelanggaran-pelanggaran penyimpanan berbasis internet tersebut pada umumnya menyebabkan kerancuan yurisdiksi sehingga pengadilan harus memperhatikan lanskap dinamis hak cipta pada komputasi awan.
