
Esta análise debruça-se sobre a ineficiência e a ineficácia das jurisdições nacionais e regionais de África na promoção e na proteção dos direitos humanos, reveladas nas constituições nacionais e nos documentos e jurisdições regionais, como a Carta Africana dos Direitos Humanos e dos Povos e o Tribunal Africano dos Direitos Humanos e dos Povos. Daqui resulta a ausência generalizada de respeito pelos direitos humanos, e a extensão da cultura da impunidade e do silêncio no continente. A consequente atuação do Tribunal Penal Internacional em África provoca um confronto com alguns governos que, no seio da União Africana, questionam a sua autonomia e universalidade. The present analysis addresses the inefficiency and inefficacy of African national and regional jurisdictions in the promotion and protection of human rights, both in national constitutions and in regional documents and jurisdictions, such as the African Charter on Human and Peoples' Rights and the African Court on Human and Peoples' Rights. The result of the above-mentioned inefficiency is the overall disrespect for human rights in Africa and the growth of a culture of impunity and silence. The ensuing action of the International Criminal Court (ICC) in the continent has led to a confrontation with some African governments which, within the framework of the African Union, challenge the autonomy and universality of the ICC.
