La justicia constitucional en América Latina

Abstract

Los análisis más recientes de derecho constitucional comparado demuestran que en el mundo prevalece el modelo concentrado de control de constitucionalidad1. No obstante, en los países de América Latina concurren todos los sistemas y métodos de justicia constitucional que existen hasta ahora. Desde el establecimiento de tribunales constitucionales especializados con la función exclusiva de realizar un control concentrado de la conformidad de la ley con la Constitución, hasta la facultad de todos los jueces para realizar el control difuso de constitucionalidad; desde el control previo de constitucionalidad para determinados actos, hasta el control posterior sin caducidad de los actos del legislador; desde la legitimación restringida para solicitar la intervención del juez constitucional, hasta el modelo de acceso directo de los ciudadanos mediante la acción popular o pública de constitucionalidad; desde modelos que asignan la última palabra sobre la constitucionalidad de la ley a los jueces, hasta experiencias que introducen elementos del constitucionalismo dialógico, mediante el sistema de respuestas legislativas a las decisiones de los tribunales o el modelo bilateral de reparación de la discriminación normativa.
