Abstract

Los programas de cumplimiento (compliance) en materia de competencia aún no son una realidad jurídica en el país. En el ámbito colombiano, y de cara al sobreviniente estatus jurídico de Estado miembro de la Organización para la Cooperación y el Desarrollo Económicos (ocde), la autoridad de competencia debe liderar la construcción e implementación de la guía que señale las pautas necesarias dirigidas a las entidades que quieran cumplir con la ley de manera efectiva, por lo que la construcción colectiva de normativas son el camino más efectivo para seguir fortaleciendo el régimen de libre competencia económica en Colombia. La implementación de medidas de cumplimiento (compliance) para los agentes económicos del siglo xxi, además de ser una necesidad, es un interés, pues a estos no les es suficiente el cumplimiento de la ley, sino que van más allá del formalismo, implementando una verdadera cultura empresarial fundamentada en la ética. Estos principios mejorarán la competitividad no solo de las empresas, sino del mercado en general, satisfaciendo así el propósito general del régimen jurídico del derecho de la competencia.

Compliance programs in competition law are still not a reality in Colombia. Bearing in mind that the country is an overcoming member of the oecd, the competition authority should be the one that encourages the construction and implementation of guidelines and policies in order for businesses to comply effectively with the law, as well as to strengthen the free market, the economic liberties, and the legal framework of competition. The implementation of effective compliance programs for the economic agents in the 21st Century is not only a necessity, but it is also a true interest. The actors in the market are not only willing to comply with the law, but also to pursue a corporative culture based on ethics. These principles help to improve competitiveness and create a healthy market, by satisfying the purposes of the legal competition framework.
