Abstract

Para el Derecho Administrativo, resulta de vital importancia, es decir, las particularidades del elemento nexo causal dentro de la estructuración de la responsabilidad Extracontractual del Estado. Se desarrolla, entonces, una investigación Jurídica Básica en el cual se otorga primacía a la sistematización de la jurisprudencia sobre el rompimiento del nexo causal en los procesos de responsabilidad extracontractual del Estado, para el cual es necesario realizar una revisión literaria de la Constitución Política de Colombia de 1991, la Ley, la jurisprudencia de la Corte Constitucional y el Consejo de Estado; Esto se debe a que los principios doctrinarios colombianos en Derecho Administrativo logran como resultado la confirmación de la hipótesis. Los criterios que sirven de fundamentos son múltiples y variados, los cuales se remiten al riesgo de las cosas o la actividad, al riesgo creado, al peligro y al control de las fuentes del riesgo, a la distribución del riesgo, a la relación costo de prevención y daño generado, entre muchas otras; Lo que se debe lograr es la exoneración de la responsabilidad.
