A imputabilidade penal do psicopata criminoso

Abstract

O presente artigo aborda a complexa relação entre a psicopatia e a imputabilidade penal. Trata sobre a questão da responsabilidade penal dos criminosos diagnosticados com o transtorno de personalidade e como é de extrema importância examinar e considerar as características que os portadores desse transtorno possuem, tais como a falta de empatia, impulsividade e manipulação, no processo de sua penalização. O crime cometido por esses indivíduos está cada vez mais comum, devido ausência de uma legislação penal direta e explicita sobre o assunto, considerando em sua maioria, os portadores de psicopatia como semiimputaveís ou até mesmo inimputáveis. Os psicopatas possuem plena consciência do que fazem, tendo conhecimento do ilícito e são extremamente racionais, possuindo assim, plena intenção em cometer o delito. O objetivo do artigo é demonstrar a culpabilidade do psicopata criminoso e como este deve ser considerado imputável, e as maneiras de responsabilização ante a legislação penal brasileira.
