Conceptos elementales sobre derecho y moral. Los derechos humanos y la justicia

Abstract

La moral y el derecho tienen una relación inconmensurable; si bien es cierto, que muchos siglos fue de tolerancia entre un mundo y otro, durante el estado de derecho y los postulados del movimiento de la codificación llegó a visualizarse como una imposibilidad material de vinculación; sin embargo, los acontecimientos de la Segunda Guerra Mundial y la nueva comprensión de la norma positivizada trastocaron esa concepción, para dar paso a la acuñación de un concepto que comparte, en su naturaleza, elementos tanto éticos como jurídicos: los derechos humanos. En ese contexto, vamos a revisar diversos tópicos relacionados con ambos mundos, para arribar, finalmente, al punto en que la justicia aparece, con un doble enfoque: hacia los valores formales, cuyo parámetro de regularidad está constituido por la legalidad, y hacia los valores fundamentales y superiores, cuyo control de actuación está determinado por la constitucionalidad y la convencionalidad, ambos basados en los derechos humanos.
