El Proceso Judicial según Jorge Luis Borges

Abstract

Nuestro trabajo se dispara en la confluencia extravagante de un Borges ensayista y provocador con un Foucault provocador y ensayista, para derivar hacia una concepción del Proceso Judicial como relato, que aporta de modo instituyente a la construcción del discurso jurídico en nuestras sociedades de capitalismo desordenado —en categoría de Offe (1990, 2009)— con el fin explícito, de quien suscribe, de ensayar alguna línea crítica a ese objeto de estudio llamado Derecho.Proceso Judicial como confrontaciones discursivas que se acumulan y superponen construyendo una urdiembre de relatos intrincada y densa, no siempre pertinente y mayoritariamente superflua, que transita por los carriles de “lo verosímil” casi como una burla al “principio de verdad” que el sistema de justicia se arroga. Proceso Judicial como “discurso clandestino”, como discurso del orden. Discurso del poder, discurso del “como si”. O “definir un crimen como si fuera una mariposa y viceversa”.
