The role of Unit for support to children/witnesses in criminal procedings

Abstract

The state of Serbia has made a major effort to harmonize the domestic legal framework with international, as well as to implement the taken commitments in practice. The commitments are related to the area of the reform of child protection and child-friendly justice, which ensures respect for the best interests of the child, when the child comes into contact with the social protection system and the judicial system. In this way, the state prevents secondary victimization of children and makes recommendations as to create strategies for overcoming stress in connection with the participation of children in court proceedings. For this reason there is a need for forming a Unit to support child victims-witnesses in criminal proceedings. They are formed in four cities: Belgrade, Niš, Novi Sad, Kragujevac and they operate at the regional level. The experience of a year’s work of the Unit has shown that when the child is well prepared, they more readily and better testify to the Body of the process as well as increases the confidence of the child and family in the court proceedings. It is important to achieve efficiency of the judicial system and ensure the access to justice for all citizens. Professionals engaged within the Unit belong to the system of social protection, the very professional staff who Juvenile Justice recognizes as providers of support to victims / witnesses. They are specially trained to inform the child and family on the court proceedings, to support the Body during the process of taking testimony, to conduct forensic interviews and provide counselling and therapeutic support. However, the state needs to make additional efforts also with project activities, to systematically solve the problem by forming services of trained professionals who provide assistance and support to children-victims / witnesses of crimes. This is a good moment for the formation of such services, given that the section 23 has been opened, which is the right moment for all initiatives relating to the improvement of basic human rights and expedition of the judicial reform related to children. 

Република Србија спроводи свеобухватне реформе правосуђа и система социjaлне заштите, а њихов рад усклађен је са међународним и европским стандардима. Србија је отворила поглавље 23, што представља прави тренутак за све иницијативе које се тичу унапређења основних људских права и убрзавања процеса реформе правосуђа. Област реформе дечије заштите и правосуђа по мери детета обезбеђу је поштовање најбољег интереса детета, онда када дете дође у контакт са системом социјалне заштите и правосудним системом. Деца су значајан и важан део судског процеса и могу бити поуздани сведоци. Препознавања значаја учешћа и заштите деце у судским поступцима довело је до формирања Јединице за подршку деци жртвама/сведоцима у кривичном поступку настале су у оквиру пројекта Унапређење права детета кроз јачање система правосуђа и социјалне заштите у Србији, који финансира ЕУ, а спроводи УНИЦЕФ у партнерству са Министарством правде и Министарством за рад, запошљавање, борачка и социјална питања. Пројекат је почео у августу 2014. и траје до марта 2017. године. Јединице су формиране у четири града: Београд, Ниш, Нови Сад и Крагујевац и функционишу на регионалном нивоу. Подршка деци у кривичном поступку подразумева: заштиту детета од секундарне виктимизације током судског поступка, упознавање детета са судским поступком, разјашњавање улога свих учесника, повећање способности детета да спремније и квалитетније да исказ и повећање поверења детета и породице у судски поступак. У складу са тим у раду ће бити представљене бројне улоге Јединица за заштиту деце жртава или сведока у кривичном поступку, као и њихов значај не само за дете већ и за правосудни систем који у складу са Конвенцијом о правима детета, бројним међународним документима и домаћим законима, креће путем реформи и кроји „правосуђе по мери детета“.
