Sistema de justiça criminal brasileiro e o racismo institucional

Abstract

Neste artigo, apresenta-se o sistema de justiça criminal como um instrumento de inferiorização da população negra, que é o grupo-alvo da seletividade penal de forma naturalizada e normalizada, e sua utilização para a manutenção da discriminação racial enraizada no Estado brasileiro. A partir da análise dos casos Marielle Franco, Bárbara Quirino de Oliveira, dentre outros, nota-se que as instituições do sistema de justiça criminal brasileiro definem a população negra como criminosa antes da prolação de uma sentença condenatória nos casos concretos. Por fim, conclui-se que as leis antirracistas não têm sido suficientes para alterar essa realidade, que é evidenciada em diversas situações.
