TEORIA DA CAPTURA NO SETOR PÚBLICO

Abstract

O presente trabalho tem como objetivo estudar a incidência da captura no setor público, que pode ocorrer tanto por agentes econômicos, quanto pelo próprio governo. De plano é explorada a formação estatal e como se deu a implementação do atual modelo neoliberal, pelo qual fora pesquisado os aspectos do Estado Absolutista, Liberal, Social e Neoliberal. Nessa esteira analisar-se-á o Estado Regulador e sua evolução, dada influência das experiências regulatórias, em especial norte-americana, principalmente no que diz respeito ao contexto econômico e social, no qual o Estado intervirá indiretamente na ordem socioeconômica, por intermédio das agências reguladoras, que são um ponto de equilíbrio entre usuários, regulados e governo. Apesar da importância destes órgãos reguladores, pelo fato de participarem diretamente na fiscalização e normatização dos setores regulados, tem-se verificado o desvirtuamento de sua finalidade, desde por imperfeições de mercado, como pelas falhas de governo, com risco de captura das agências, pelas empresas reguladas ou pelo agente governamental colocando em perigo o interesse público. Ao final, os estudos demonstram a relevância do tema para a sociedade, pelo fator econômico e social. Para tanto se utilizou, o método dedutivo, a partir de pesquisas bibliográficas históricas, políticas e jurídicas, bem como análise doutrinária e legislação acerca do proposto, pelo qual pode ser constatada, a inevitabilidade de aplicar-se medidas que impeçam o fenômeno da captura
