Análisis crítico de la “Ley Amnistía” en el Perú: La imprescriptibilidad en debate

Abstract

El presente trabajo busca abordar el debate actual originado por la reciente promulgación de la “Ley Amnistía” en el Perú, la cual propone disposiciones que permiten la cesación de procesos judiciales por delitos de lesa humanidad, sin considerar que, de acuerdo con los parámetros del derecho internacional penal, estos delitos deben ser siempre perseguidos. Se evaluarán no solo sus efectos en el contexto jurídico, sino también político y social, y cómo su implementación colisiona con los compromisos internacionales asumidos. Asimismo, se tomarán en cuenta las alegaciones que sostienen que la nueva normativa proporciona estabilidad jurídica en el ordenamiento peruano, frente a la incidencia maximizada del debilitamiento actual de los derechos en el país y el acceso a la justicia para todos aquellos afectados por el conflicto interno ocurrido hace 45 años.
