İDARİ YARGILAMA USULÜNDE KANUN YARARINA TEMYİZ

Abstract

Kanun yararına temyiz, İdari Yargılama Usulü Kanununda düzenlenen olağanüstü kanun yollarından biridir. İdari yargı yerlerinin kesin olarak verdikleri kararlar ile kesin olarak verilmemiş olmakla birlikte kanun yolları aşamasında taraflarca başvuru yapılmaması sebebiyle kesinleşen nihai kararları, kanun yararına temyiz başvurusuna konu edilebilir. Kanun yararına temyiz incelemesi sonucu verilen kararlar, İdari Yargılama Usulü Kanununun 51. maddesi uyarınca başvuruya konu edilen mahkeme kararının hukuki sonuçlarını ortadan kaldırmamaktadır. Kesin hüküm kavramı çerçevesinde yorumlanan bu düzenleme, kanun yararına temyiz incelemesi sonucunda verilecek bozma kararının kendi hukuki sonuçları olmayacağı anlamını taşımamaktadır. İptal talebinin reddi yönündeki kararlar kesin hüküm niteliği taşımaz ve bu tip kararların kanun yararına bozulması hukuki sonuç doğurabilir. Kanun yararına bozma kararının uyuşmazlığın esasına ilişkin bir hukuka aykırılık saptaması durumunda, hukuka bağlı idarenin uymakla yükümlü olduğu bir yargı kararı ortaya çıkar. Başka bir ifadeyle bu hâllerde idare, kanun yararına temyiz sonucu verilen bozma kararına uymakla yükümlüdür ve bu yükümlülük, ilgililerce talep konusu edilebilir niteliktedir.
