Informe sobre neurotecnología y tratados internacionales: ¿Un tratado internacional sobre neuroderechos?

Abstract

El informe examina el estado actual del derecho internacional aplicable a la neurotecnología e identifica una brecha entre las normas existentes y las capacidades emergentes. Instrumentos como el PIDCP, la CDPD y el Convenio de Oviedo garantizan la privacidad, la libertad de pensamiento y la integridad mental, pero no fueron concebidos para tecnologías que pueden acceder, inferir o modificar procesos neuronales, lo que pone de manifiesto sus límites interpretativos y normativos. A continuación, analiza las iniciativas internacionales recientes, en particular en el ámbito de las Naciones Unidas, la OCDE, la UNESCO y el Consejo de Europa, destacando su carácter fragmentario y predominantemente no vinculante. Asimismo, examina el debate doctrinal sobre los neuroderechos, entre propuestas de nuevos derechos y enfoques basados en la reinterpretación de los existentes. El informe concluye que un tratado internacional específico es poco viable a corto plazo y propone, en su lugar, el desarrollo progresivo de estándares mediante instrumentos de soft law, que podrían conducir eventualmente a lograr consensos que terminen en un convenio internacional.
