Abstract

<p><span>Environmental rights are fundamental to ensuring a healthy, safe, and sustainable environment for present and future generations. However, enforcing these rights in Nigeria has been fraught with numerous challenges. This study critically analyzes the challenges hindering the effective enforcement of environmental rights in Nigeria, with the aim of identifying the key obstacles and proposing recommendations to strengthen the enforcement framework. The study employs a doctrinal research methodology, examining relevant legislation, case law, and secondary sources. The findings reveal that the main challenges include inadequate legal and institutional frameworks, weak enforcement mechanisms, insufficient funding, lack of political will, and limited public awareness and participation. Inadequate legal frameworks result in gaps and inconsistencies in environmental protection, while weak institutional capacity hinders effective monitoring, investigation, and prosecution of environmental violations. Insufficient funding and resources limit the ability of enforcement agencies to carry out their mandates, and lack of political will undermines the prioritization of environmental protection. Limited public awareness and participation also contribute to the challenges, as citizens are often unaware of their environmental rights and how to assert them. The study concludes that addressing these challenges requires a comprehensive approach involving legal reforms, institutional strengthening, increased funding, political commitment, and public engagement. Recommendations include harmonizing environmental laws, establishing specialized environmental courts, enhancing the capacity of enforcement agencies, allocating adequate resources, promoting environmental education, and fostering partnerships between government, civil society, and the private sector. By implementing these recommendations, Nigeria can strengthen the enforcement of environmental rights and promote a more sustainable future.</span></p> <p><span>&nbsp;</span></p> <div> <span><br></span> </div>
