Is the ‘unfair competition’ contemplated in the intellectual policy (IP) field conceptually distinct from – even in an entirely different category from – the kind of anti-competitive acts at which competition policy takes aim? Is it potentially confusing and counterproductive for policymakers, legislators and analysts to seek commonality between these two stylized notions of ‘competition’, or is it a contribution – even a prerequisite – for a systematic and coherent understanding of the interplay between IP and competition policy?
