Abstract

Spanish Abstract: La propagacion mundial del COVID-19, ademas del incalculable costo social, ha impactado severamente a la economia global. Bajo este contexto, el arcaismo de la regulacion concursal ecuatoriana no se compadece con la necesidad de asegurar, por un lado, la supervivencia de aquellas sociedades mercantiles que afrontaren dificultades transitorias que, por una u otra razon, surgieren durante su devenir operacional; y, por otro, de mejorar sus procesos de cierre cuando su extincion fuere, operacionalmente, la unica opcion existente. Con fundamento en esta realidad, Ecuador emitio la denominada ‘Ley Humanitaria’. Entre otros aspectos, esta Ley implemento un proceso concursal excepcional y reconocio, por primera vez en el pais, a los acuerdos preconcursales, con el objeto de mitigar los efectos adversos que el brote del coronavirus ha causado en el Ecuador. El presente ensayo analizara la regulacion de los procesos concursales excepcionales y de los acuerdos preconcursales, prevista en la Ley Humanitaria para minimizar los impactos economicos adversos del COVID-19 en Ecuador. Disclaimer: Este trabajo academico se fundamenta en la presentacion que los autores realizaron en el XVI Congreso del Instituto Iberoamericano de Derecho Concursal (IIDC), titulado ‘El Derecho de Crisis en la Pandemia’. English Abstract: Due to the international spread of COVID-19, an increasing number of businesses are in the vicinity of insolvency. Others, because of this pandemic, have already gone insolvent. Unfortunately, the formal insolvency proceedings in Ecuador, due to their inefficiencies and complexity, will not ensure the survival of economically viable companies dealing with financial difficulties due to this crisis. As a response to the current economic situation, Ecuador enacted the 'Humanitarian Act', whose objective is to mitigate the pandemic's adverse economic effects. This paper analyses the exceptional insolvency proceedings and the extrajudicial reorganization agreements recognized by the Ecuadorian Humanitarian Act to minimize the adverse economic impact derived from the COVID-19 pandemic.
