Abstract

Spanish Abstract: La impotencia era, en derecho matrimonial, aquel defecto congenito o sobrevenido que imposibilitaba el acto sexual entre la mujer y el hombre y hacia nulo el matrimonio. Su razon de ser tiene una conexion directa con la naturaleza y los fines de la institucion matrimonial. El articulo estudia este impedimento en la legislacion y los tratados doctrinales de Hispanoamerica entre los siglos XVI y XVIII. Se presta atencion a las diversas clasificaciones y sintomas de este impedimento, a la ciencia medica del momento y a los diversos supuestos que tienen incidencia en el, como el caso de los impuberes, los hermafroditas y los afectados por maleficio. Se tratan tambien los aspectos procesales de la declaracion de nulidad por impotencia. English Abstract: Impotence was, in matrimonial law, the congenital or accidental defect that renders the sexual intercourse between woman and man impossible and produces the nullity of the marriage. It has a direct connection with the nature and goals of the institution of matrimony. This article analyzes this impediment in the legislation and doctrinal treaties of Latin America between the 16th and 18th centuries. It focuses on the different classifications and symptoms of this impediment, on the medical science at the time, and on the different facts that had an impact thereon it, such as the case of prepubescents, hermaphroditism and those affected by witchcraft. The procedural aspects of the declaration of nullity for impotence are also dealt with.
