Spanish Abstract: La LO 5/2010, de 22 de junio, por la que se modifica la Ley Organica 10/1995, de 23 de noviembre, del Codigo Penal, incorporo en el art. 301.1 como conductas especificas de blanqueo, la posesion y utilizacion de bienes de procedencia delictiva. Estas conductas que fueron derogadas tras la Promulgacion del Codigo penal de 1995 vuelven a ser incorporadas al texto legal, dificultando aun mas la labor interpretativa del tipo si se tiene en cuenta el castigo del autoblanqueo y el mantenimiento de la formula del «cualquier otro acto». Este estudio analiza el alcance de ambas conductas especificas, y si bien la tecnica legislativa utilizada en la redaccion del tipo admite una interpretacion amplia y otra restrictiva, se opta por esta ultima con el objetivo de hacer compatible la aplicacion del delito de blanqueo con los principios y garantias derivadas del Estado del Derecho. English Abstract: The Act 5/2010, of June 22th, by amending the Act 10/1995 of November 23th, Criminal Code, incorporated in the art. 301.1 as specific behaviors laundering, possession and use of property of criminal origin. These behaviors, that were repealed after the enactment of the Criminal Code in 1995, are again incorporated into the statute, interfering with the interpretative work, taking into account the punishment of self-laundering and maintenance of the formula of «other act. This study analyzes the extent of both specific behaviors, and although the legislative technique used in type´s redaction supports a broad and one narrow interpretation, the latter is chosen in order to support the implementation of the crime of money laudering with principles and guarantees recognized under the rule of law.
