Abstract

Arabic Abstract: تنطلق هذه الورقة من أهمية موضوعها الذي يستعرض السلطة التأسيسية الأصلية التي تقوم بوضع الدستور عندما تكون الدولة خالية تماما من النصوص الدستورية النافذة، وكذلك السلطة التأسيسية المعدلة التي تهتم بتعديل نصوص الدستور؛ بما يواكب التغيرات الاجتماعية والسياسية والقانونية التي تعاصرها الدولة. واهتمت الدراسة ببحث آلية تبني النصوص الدستورية وآليات تعديلها، والقيود المفروضة على كل منها. ومن النتائج التي تم التوصل إليها أن السلطة التأسيسية الأصلية تتبنى النصوص الدستورية دون الاستناد إلى نصوص قانونية أو دستورية تحكمها، وتعتمد في ذلك على طرق ديمقراطية تتمثل بالجمعية التأسيسية أو الاستفتاء وأخرى غير ديمقراطية تتخذ شكل المنحة أو العقد. بينما تستند السلطة التأسيسية المعدلة في قيامها على دستور قائم ونافذ يحدد السلطة المختصة بتعديل الدستور، والإجراءات المتعين عليها اتباعها لذلك. English Abstract: This paper is about the constituent power, i.e. the power to frame a new constitution, or to the power to amend an existing one. The study mainly examines the mechanisms for adopting a new written constitution or amending it, and the restrictions imposed upon that constituent power. One of the findings is that the framing power adopts the constitutional provisions without relying on legal or constitutional provisions governing them. Instead, they can be adopted through democratic methods – such as a constituent assembly or a referendum – or through undemocratic methods – where the constitution is granted by the sovereign or the result of a contract between the sovereign and the governed. The amending power is based on an existing constitution which sets out the competent authority to amend the constitution and the procedures to be followed.
