Spanish Abstract: El texto ofrece un analisis del Proyecto de la llamada Ley Emilia, para sancionar a conductores que causan muerte manejando en estado de ebriedad, en el contexto del Derecho comparado, la critica criminologica al populismo penal y los efectos que los cambios previstos producen en el sistema general del Derecho penal vigente, cada vez mas incapaz de ofrecer respuestas adecuadas a las nuevas valoraciones sociales. English Abstract: The text provides an analysis of the Emilia’s Draft Law to punish driving while intoxicated homicides, in the context of comparative law, criminological critique of penal populism and the changes in the general system of current chilean Criminal Law, increasingly unable to provide suitable responses to changing new social values.
