Abstract

Portuguese Abstract: O artigo versa sobre a expansao do direito penal e a consequente utilizacao de instrumento do direito penal negocial. A expansao do direito penal e apresentada como consequencia do fenomeno da globalizacao, da ordem politica e economica mundial e do aumento da complexidade das relacoes sociais. O trabalho destaca a importante contribuicao do direito internacional ao tema, especialmente, por meio de sua funcionalizacao, isto e, a utilizacao de ferramentas interpretativas e solucoes normativas oriundas da internacionalizacao do direito. Apesar das criticas a expansao do direito penal, o fenomeno mostra-se inevitavel. De igual modo, tambem a expansao das solucoes trazidas pelo direito penal negocial, tais como a colaboracao premiada e a barganha penal. Por meio de analise documental e revisao bibliografica, com destaque aos projetos legislativos de novos codigos penal e de processo penal, a abordagem trazida pelo artigo mostra-se relevante por buscar a compatibilizacao desses institutos com a ordem constitucional brasileira. English Abstract: The article assays on the criminal law expansion and therefore the use of instruments of the negotiation on criminal law. A criminal law’s expansion is presented as a consequence of the globalization, the economic and political order worldwide and the complexity increase of social relations. The study focus the essential contribution of the International Law, specifically the functionalization as a phenom due to the internalization of the law in general. The functionalization refers to the use of tools and solutions derived from the international law. Despite the criticism, the criminal law’s expansion is inevitable. Thus, the expansion of the negotiation on criminal law and its solutions is unavoidable, such as legal collaboration and plea bargaining. From a literature review and document analysis about the subject, this paper mentions the bills proposing a new criminal procedure code and a new criminal code in Brazil. The relevancy of this approach consists on the pursue of conformity of these inevitable projections and the Brazilian constitutional principles.
