Abstract

Spanish Abstract: La racionalizacion de los servicios locales ha dado lugar a reformas en los paises de nuestro entorno, normalmente motivadas por las ineficiencias asociadas al llamado “inframunicipalismo”. Tambien en nuestro pais, numerosas voces abogan por una organizacion mas eficiente, aunque las diferencias acerca del modo de concretar la reforma son ciertamente acusadas. A finales del mes de agosto, el Gobierno remitio a las Cortes Generales el Proyecto de Ley de racionalizacion y sostenibilidad de la Administracion local. Una de las vias por las que opta el Proyecto es fortalecer las diputaciones, favoreciendo un proceso de asuncion de competencias basicas de los municipios pequenos por parte de aquellas. Este trabajo se centra, principalmente, en el modo en que se lleva a cabo dicha asuncion, algo que ha variado tras las advertencias del Consejo de Estado sobre el Anteproyecto.English Abstract: The need of rationalizing the municipal services has given rise to various institutional reforms in several European countries. These reforms are usually motivated by the inefficiencies associated with the so-called "inframunicipalism", that is, the predominance of small municipalities which are not able to efficiently carry out the public services they have been entrusted. Several lawyers and economists in Spain have urged a more efficient organization, but the opinions regarding the ideal reform differ. At the end of August 2013, the Spanish Government submitted to the parliament a "Preliminary Bill for the Rationalization and Sustainability of Local Government". In order to rationalize the local government, the bill promotes the transfer of basic services from small municipalities to the provincial authorities. This work examines the rules governing this transfer, taking into account the warnings of the Council of State concerning the constitutionality of the bill.
