Portuguese Abstract: O objetivo do presente artigo e apresentar as principais ideias, analisar e expandir o conceito de Law and Economics (Analise Economica do Direito). A Analise Economica do Direito surge nos Estados Unidos da America em meados da decada de 50 e, desde entao, ganhou espaco e se estabeleceu na Academia norte-americana e comeca a receber atencao no Brasil. Seria a Analise Economica do Direito um novo metodo de predicao e prescricao de politicas publicas que afetam a sociedade e seu bem-estar? Os fundamentos da Analise Economica do Direito se encontram no consequencialismo e na visao instrumentalista de racionalidade. Espera-se que o presente artigo apresente aos usuarios da AED os principais contornos da teoria, bem como suas vantagens e limitacoes.English Abstract: The purpose of this paper is to present the main ideas, examine and expand the understanding of the concept of Law and Economics. Law and Economics became known in the United States in the mid 50's and, since then, became prominent in the American Academy and starts to gain momentum in Brazil. Is Law and Economics a new method of prediction and prescription of policies that affect society and their well-being? Law and Economics has roots in consequentialism and instrumentalistic views of rationality. This paper will present the main ideas, advantages and disadvantages of Law and Economics.
