Spanish Abstract: El presente escrito tiene como proposito hacer una aproximacion a la ilicitud del contrato como consecuencia de la violacion de una norma imperativa, prevista en los Principios Unidroit Para los Contratos Internacionales en su version de 2010. Por ello, en primer lugar se analizaran los motivos y razones que tuvieron el Consejo de Gobierno y el Grupo de Trabajo encargado de hacer la version 2010 de los Principios Unidroit para incluir la ilicitud del contrato como uno de sus nuevos temas a tratar, y la forma en la que se llevo a cabo el debate al interior del grupo de trabajo, hasta la adopcion del texto final. Posteriormente, se hara una breve comparacion entre los alcances y efectos previstos por Unidroit para este principio: la interpretacion y aplicacion que del mismo ha hecho en Colombia, para finalizar con las criticas que se han elevado en contra de este nuevo principio.English Abstract: This paper seeks to approach contract illegality resulting from the contravention of statutory or public policy prohibitions as foreseen by the 2010 version of the Unidroit Principles. To achieve this purpose, the motives and reasons taken into account by Unidroit’s Governing Council and the Study Group in charge of the drafting of the 2010 version, that led to the inclusion of contract illegality as one of the new topics to discuss will be analyze, as well as the way in which the debate was carried out by the Study Group until the approval of the final text. Subsequently, a brief comparison between the scope and the effect expected for this principle by Unidroit in contrast to the interpretation and enforcement that this principle has had in Colombia will be made, closing with the critiques that have arisen against this new principle.
