Abstract

English Abstract: This paper seeks to approach contract illegality resulting from the contravention of statutory or public policy prohibitions as foreseen by the 2010 version of the Unidroit Principles. To achieve this purpose, the motives and reasons taken into account by Unidroit’s Governing Council and the Study Group in charge of the drafting of the 2010 version, that led to the inclusion of contract illegality as one of the new topics to discuss will be analyze, as well as the way in which the debate was carried out by the Study Group until the approval of the final text. Subsequently, a brief comparison between the scope and the effect expected for this principle by Unidroit in contrast to the interpretation and enforcement that this principle has had in Colombia will be made, closing with the critiques that have arisen against this new principle.
