Portuguses Abstract: O objetivo deste artigo e apresentar um panorama geral sobre a regra de neutralidade da rede aprovada no Marco Civil da Internet (Lei Federal n. 12.965/14), expondo alguns dos principais desafios para reguladores e aplicadores do Direito no que se refere a interpretacao dessa regra. Como forma de enderecar essa problematica, esse artigo traz quatro contribuicoes: (i) apresenta uma revisao e organizacao da literatura sobre o tema e suas propostas de regulacao, (ii) oferece uma analise aprofundada da regra de neutralidade da rede no Marco Civil, apresentando tambem criticas ao texto aprovado, (iii) apresenta um modelo de analise logica para auxiliar reguladores e aplicadores do Direito na interpretacao do Marco Civil, e (iv) discuti quais devem ser os principais casos dificeis que deverao ser enfrentados por reguladores e aplicadores do Direito no futuro proximo.English Abstract: The goal of this paper is to provide to researchers and regulators a general framework about the net neutrality rule established in 2014 in Brazil. This paper makes four contributions: i) it presents the state-of-the-art of net neutrality regulatory discussions worldwide, (ii) it presents the first in-depth analysis of the net neutrality provision of the Marco Civil, (iii) it provides a logical test for adjucation in net neutrality cases in Brazil and (iv) it provides a guideline for further studies of this subject.
