Abstract

Portuguese Abstract: Proposta sobre a cooperacao juridica internacional, elaborada em setembro de 2011, para subsidiar o Substitutivo referente ao projeto do novo Codigo de Processo Civil brasileiro (Projeto de Lei do Senado no 166/2010, Projeto de Lei da Câmara no 8.046/2010), o qual e de autoria de Ada Pellegrini Grinover, Presidente de Honra do Instituto Brasileiro de Direito Processual (IBDP), Carlos Alberto Carmona, Secretario-Geral do IBDP, Cassio Scarpinella Bueno, Diretor de Relacoes Institucionais do IBDP, e Paulo Henrique dos Santos Lucon, Vice-Presidente do IBDP. Os topicos abordados na proposta sao os seguintes: limites da jurisdicao brasileira e cooperacao internacional; principios gerais e modalidade de cooperacao juridica internacional; competencia e litispendencia internacional; competencia concorrente e competencia com carater excludente; litispendencia e conexao; eficacia da decisao estrangeira; efeito automatico da decisao estrangeira; requisitos para a eficacia da decisao estrangeira; acao de reconhecimento de sentenca estrangeira; execucao de decisao estrangeira; laudo arbitral estrangeiro; medida judicial de urgencia na esfera transnacional (internacional); auxilio mutuo: conceito e extensao; carta rogatoria: conceito e alcance.English Abstract: Proposal for international legal cooperation created as a supplement to or substitute for the New Code of Civil Procedure (Senate Bill No. 166/2010, House of Representatives Bill No. 8.046/2010), whose authors are Ada Pellegrini Grinover, Honorary President of the IBDP (Brazilian Institute of Procedural Law), Carlos Alberto Carmona, Secretary-General of the IBDP, Cassio Scarpinella Bueno, Director of Institutional Relations of the IBDP, and Paulo Henrique dos Santos Lucon, Vice-President do IBDP. The following topics discussed in this text: the limits of Brazilian jurisdiction and international cooperation; general principles and procedures of international legal cooperation; jurisdiction and lis pendens -- concurrent jurisdiction, exclusive jurisdiction, lis pendens and nexus; enforceability of foreign judgements; autosatic effect of foreign judgements; requirements for enforceability of foreign judgements; action for recognition of foreign judgements; enforcement of foreign judgements; foreign arbitral awards; urgent judicial measures in the transnational (international) arena; mutual assistance -- concept and extension; letters rogatory -- concept and scope.
