El presente trabajo tiene como finalidad no solo exponer las particularidades del precedente constitucional, tambien exponer por igual algunas reflexiones a la luz de algunas decisiones dictadas por el Tribunal Constitucional, las cuales pueden ser replicadas en un sistema analogo. Para ello, analizaremos el precedente constitucional, en cuanto a sus generalidades, fundamentos y elementos que componen dicha figura juridica (I); y por ultimo analizaremos la interaccion del precedente respecto al ordenamiento juridico y casos concretos, a proposito de su aplicabilidad en un caso o inaplicabilidad en otro, y su posible revocacion u overruling (II).This paper aims not only to discuss the particularities of constitutional precedent, as well to reflect on the precedent vis-a-vis a few decisions rendered by the Constitutional Court, which can be replicated as well in a similar system. In order to do this, we will analyze the constitutional precedent, in general terms; its foundations and its elements (I), and finally, we will analyze the interaction of the precedent regarding the legal system from the perspective of specific cases concerning its applicability in a case or unenforceability in another, and its possible revocation or overruling (II).
