El presente trabajo, partiendo del analisis de la Sentencia dictada por el Tribunal Supremo con 9 de julio de 2012, examina los errores mas comunes a la hora de interpretar los datos estadisticos derivados de la prueba de ADN incorporados al proceso penal, lo que nos llevara a reflexionar sobre la utilidad de este tipo de material probatorio como argumento incriminatorio; y, de otro lado, sobre la forma correcta de interpretar estos datos, asi como sobre la valoracion judicial que debe realizarse de la prueba cientifica y, mas especificamente, de la de ADN.This paper, while analyzing the ruling of the Supreme Court of July, 9th, 2012, examines the most common mistakes committed in the interpretation of statistical data regarding the DNA evidence brought to criminal proceedings. This will lead us, on the one hand, to evaluate the utility of this kind of evidence; and, on the other hand, to show the correct way of reading these data, and how it should be measured by the judges, specifically the one derived from DNA evidence.
