Abstract

O presente trabalho visa estabelecer conceitos e fixar nocoes basilares sobre o que venha a ser o positivismo juridico, delimitando algumas de suas mais importantes caracteristicas, em especial as oriundas da contribuicao de Hans Kelsen. No rastro do pensamento kelseniano, o presente opusculo almeja orientar, tambem, o que se entenda pelo direito, enquanto ciencia que se preocupa, tao-so, com a validade formal da norma posta pela autoridade competente. This work aims to establish concepts and fix basilar notions on what will be the legal positivism. It outlines some of its most important characteristics, especially those from the contribution of Hans Kelsen. In the wake of Kelsen's theory, this booklet aims to steer that which is understood by the law as a science. It is concerned, so-alone, with the formal validity of the standard laid by the competent authority.
