The Association of Turkish Students Studying in the European Union ("ATSSEU"), by and through its undersigned members of its Amicus Subcommittee, has prepared this letter ("Amicus Submission") to assist the European Court of Justice ("ECJ") in giving a preliminary ruling under Article 267 of the Treaty on the Functioning of the European Union in Leyla Ecem Demirkan v Federal Republic of Germany referred to the ECJ by the Oberverwaltungsgericht Berlin-Brandenburg. ATSSEU wishes to put forward submissions in this case on behalf of its members, it does not seek to participate any further than this in the case and is not seeking intervention. ATSSEU is not a party in the instant case, but believes this case is significant to the development of EU-Turkey Association Law and recommends that the above questions be answered by the Court in the positive because a negative answer in this case would bring to a complete halt the further development of the Association between Turkey and the EU; and promote and reinforce the substantial, unfair, discriminatory and insurmountable barriers facing movement of Turkish nationals from all sectors of Turkish society – seeking to exercise their rights under the Ankara Agreement and its Additional Protocol – and cause immediate and permanent irreparable harm to ATSSEU’s members and Turkish nationals as a whole
