Las Administraciones Publicas tienen entre sus principales objetivos dotar a la sociedad de suficientes infraestructuras que contribuyan a la mejora del bienestar de sus ciudadanos y al desarrollo economico. Este deber de la Administracion se enfrenta hoy en dia a importantes desafios presupuestarios, sobretodo, en los paises desarrollados, cuyas cuentas publicas presentan enormes deficits. En este contexto, la colaboracion publico-privada supone una alternativa a estas restricciones, sobre todo cuando son financiados bajo esquemas de Project Finance. Estos Project Finance se enfrentan a numerosos riesgos, por lo que la identificacion, atribucion y mitigacion de los mismos es absolutamente indispensable para el buen fin de la operacion. Este trabajo pretende arrojar luz al complejo sistema de atribucion y mitigacion de riesgos, sobretodo, en la estructuracion de clausulas que contribuyan a que se ejecute la operacion y que, ademas, esta se haga con ciertas garantias.Public Administration has amongst its mains objectives to grant their citizenship sufficient infrastructure which contribute to the welfare and the economic growth. Nowadays, this Administration’s duty faces important budgetary challenge, mainly, in the developed countries, whose public accounts have huge public deficits. In this context, private public partnership offers an alternative to this restriction, specially when they are funded under the Project Finance structure. These Projects Finances face many risks, so the identification, allocation and mitigation of them is absolutely necessary in order to guarantee the project success. This work’s main objective is to describe the advantage to perform works through a “PPP” explaining the complex risks’ structure, overall, through some clauses which contribute to make project viable.
