The swift and efficient recovery of claims that are not subject to any legal challenge of paramount importance for economic operators in the European Union, because late payments are a major cause of insolvency, threatening the survival businesses, especially small and medium enterprises.Thus, the European Parliament adopted Regulation (EC) no. 1896/2006 creating a European order for payment, as well as Regulation (EC) no. 861/2007 establishing a European procedure for small claims.The purpose of Regulation (EC) no. 1896/2006 is to simplify, speed up and reduce settlement costs in cross-border disputes concerning uncontested pecuniary claims by creating a European order for payment and ensure the free circulation of European orders for payment within of all Member States by establishing minimum standards whose observance renders unnecessary any intermediate proceedings in the Member State of enforcement prior to recognition and enforcement.
