CTC Chile y su Fijación Tarifaria (Tariff Setting of CTC Chile)

Abstract

La Ley General de Telecomunicaciones define el marco legal que regula al sector de las telecomunicaciones en Chile. La Subsecretaria de Telecomunicaciones (SUBTEL, perteneciente al Ministerio de Transporte y Telecomunicaciones) es la entidad reguladora, tambien la Comision Antimonopolios desempena un papel importante ya que es quien se encargara de calificar los servicios afectos a fijacion de precios si “las condiciones existentes en el mercado no son suficientes para garantizar un regimen de libertad tarifaria.” En la resolucion 515 de la Comision Resolutiva Antimonopolios (abril 1998) se considera expresamente los servicios en el Servicio Publico Telefonico Local a tarifar, entre los que destacan la linea telefonica, la conexion telefonica, las comunicaciones locales, el cargo de acceso, los servicios de asistencia de operadora, el corte y reposicion de servicio, etc. Las tarifas para este servicio solo son fijadas para las empresas dominantes, como CTC. El caso detalla los principales elementos metodologicos y administrativos definidos en la Ley, que encausaron el proceso de fijacion tarifario, asi como la propuesta tarifaria que presento la empresa, para fines de discusion desde una perspectiva contable-financiera. The Chilean General Telecommunications Law defines the legal framework governing the telecommunications sector. The Secretary of Telecommunications (SUBTEL), under the Ministry of Transport and Telecommunications, is the regulatory body, and the Antitrust Committee also plays an important role because it is the responsible for qualifying the services under tariff setting if "conditions in the market are not enough to ensure a system of free pricing." The 515 Antitrust Commission resolution (April 1998) expressly includes the next Public Telephone Services under tariff setting: telephone connection, local calls, access charges, attendant services, service cuts and reconnection. Fees for these services are set only for dominant firms, such as CTC. This case details the main methodological and administrative elements defined in the Law, which guided the tariff setting process, and the tariff proposal presented by the company, for purposes of discussion from an accounting and financial perspective.
