The Purpose of Punishment: Capital Punishment

Abstract

I am an advocate for the death penalty when heinous crimes are committed; however, through research and analyzed data the guarantee of due process is seriously missing from the Criminal Justice System. In Illinois during January of 2000, Governor George Ryan declared a moratorium on executions due to the fact that in one year 13 inmates had been wrongfully convicted, while 12 others who may have been innocent had died. All of the guarantees to a fair and impartial trial was missing; a right to adequate counsel, suppressed or misapplication of evidence, false eyewitness identification, false confessions, false testimony, false or fabricated evidence, racial bias, politics and misconduct on the behalf of prosecutors, law enforcement and judges made a mockery of our system. Like Governor Ryan, I cannot support a system that has so many deliberate errors. (AIUSA, 2010)
