Abstract

Every science is based on certain principles. The science of law i.e. the jurisprudence is no exception to it and Islamic Jurisprudence is more so. This world is so made that while doing something difficulties do arise. How to solve those difficulties requires a methodology. There is more than one way to do so. The easiest, the safest, the nearest, the least expensive and least time consuming solution is to be searched out. People are blessed with vision. They see and think and then propose their outlook which they consider the most practicable and fit on all available tests for a standard solution. Thus a theory or view point comes to light. Those who found or propound or make out such principles are called its founders or propounder. Then come forward the supporters or opponents, followers or criticizers. The reason of this support and opposition is that human dispositions and level of understandings differ as such the differences arise and some times those are reconciled and some times the differences remain as such. This reflects upon the existence of freedom of thought and expression which when remains within the proper limits to find the truth and to act upon it sincerely it is a mercy of God on his servants and when the conflicts take the shape of arrogance and falsehood mixes in it the same is undesirable and should be avoided.Points on which there is not dispute among schools of thought. All Muslims are to follow the injunctions of Islam and there is no dispute on this point. The injunctions of Islam are commandments as well as prohibitions of Allah Almighty. There is no dispute on this point as well. The Holy Qur’an and Sunnah of the Messenger of Allah (صلی اللہ علیہ و ا لہ وسلم) are the two primary sources of Islamic Law. There is no dispute over it. The problems are many and multiple, easy and complex, while the verses of the Holy Qur’an and Ahadith of the Messenger of Allah (صلی اللہ علیہ و آلہ وسلم) are numbered. There is no dispute on this. People have different levels of knowledge, wisdom, intellect, thinking, approach, and understanding. There is no dispute in this behalf. All persons neither have time nor capability to have access to the whole knowledge and there are persons who devote their time and find solutions of the issues from the sources they can tap and have access to them. There is no dispute over it. During the period of revelation of the Holy Qur’an matters were solved as the revelation came. The Messenger of Allah (صلی اللہ علیہ و آلہ وسلم) gave answer of any question put to him.
