Análisis crítico de resoluciones del Indecopi en materia de publicidad medioambiental engañosa -greenwashing-

Abstract

El green marketing es un valor agregado para productos o servicios, debido a que ayuda a la empresa a ser más competitiva en el mercado, por esa razón, algunas engañan deliberadamente a los consumidores sobre su rol ambiental o las ventajas de sus productos o servicios para el medio ambiente. La presente investigación busca determinar si en la actualidad la Ley de Represión de la Competencia Desleal (en adelante “LRCD) es suficiente para regular la publicidad ambiental engañosa. Para ello, se analizará resoluciones emitidas en primera instancia por la Comisión de Fiscalización de la Competencia Desleal (en adelante “CCD”) y en segunda instancia por la Sala Especializada en Defensa de la Competencia (en adelante “SDC”)del Tribunal del Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual (en adelante “Indecopi”), desde el 2005 hasta la actualidad que resuelvan controversias que versen sobre publicidad ambiental engañosa - greenwashing- ,y de ser el caso, se brindarán recomendaciones en el marco de lo investigado.
