Las retribuciones de los directivos: a propósito de los bonus

Abstract

Los sistemas de retribución por objetivos son muy frecuentes en nuestros días, dada la flexibilidad que supone su fijación, amparada por una regulación casi ausente. A su favor se argumenta el impacto que su establecimiento causa en el rendimiento del trabajador, con el consecuente efecto dominó para la empresa, pues a priori cuanto más productivo sea, mejores serán los resultados de la misma, generando el derecho al cobro del incentivo si se alcanzan los objetivos deseados. No obstante, pese a la carencia normativa que se ha apuntado, su alcance y límites han venido marcados por los contratos de trabajo y por la jurisprudencia, dados los diversos problemas que se pueden plantear en cuanto a su determinación, pago o en los casos complejos en que su devengo se vincula a resultados de grupo.
