Abstract

El Indecopi, a través de la Comisión de Defensa de la Libre Competencia, ejerce diversas acciones para que los agentes económicos cumplan con lo establecido en el Texto Único Ordenado de la Ley de Represión de Conductas Anticompetitivas. Entre sus funciones más relevantes de los últimos años destaca la detección de una de las conductas anticompetitivas más dañinas para el mercado: los cárteles. Mediante este tipo de prácticas los competidores acuerdan fijar precios, limitar la producción, repartirse clientes, proveedores o zonas geográficas; y, establecer posturas o abstenciones en una determinada licitación o concurso público.En el presente artículo, los autores presentan la coexistencia de los programas de cumplimiento y el programa de recompensas como herramientas de detección de conductas anticompetitivas, analizando los criterios a tomar en cuenta por las personas naturales al momento de optar por uno de ellos. En ese sentido, se plantean algunas propuestas para mejorar la implementación de ambos programas desde la disyuntiva antes señalada.
