El Aporte por Regulación a favor del OEFA bajo la lupa: ¿transgresión al principio de no confiscatoriedad?

Abstract

Uno de los principios que limitan la potestad tributaria es el principio de no confiscatoriedad. En el año 2019, el Tribunal Constitucional debatió los alcances del mencionado principio en la sentencia que declaró infundada la demanda de amparo interpuesta por una empresa minera que solicitó la inaplicación del Decreto Supremo 130-2013-PCM, por vulnerar los principios de no confiscatoriedad, legalidad y reserva de ley. En el presente artículo, la autora analiza si el Aporte por Regulación a favor del OEFA vulnera el principio de no confiscatoriedad y para ello, explica qué tipos de tributo se encuentran regulados en el ordenamiento jurídico peruano y cuál es el tratamiento legal que se ha establecido para cada tipo. Asimismo, expone brevemente algunos comentarios en relación con la sentencia del Tribunal Constitucional.
