Deferencia por sumisión. La Corte Constitucional del Ecuador ante el abuso de los estados de excepción en el Ecuador (2021-2025)

Abstract

Esta investigación analiza la actuación de la Corte Constitucional del Ecuador en la supervisión de los estados de excepción decretados entre 2021 y 2025, período en el cual se han emitido 34 decretos en respuesta a crisis sociales y de seguridad. Se revela que, en la mayoría de los casos, la Corte ha garantizado el cumplimiento de los requisitos formales y ha llevado a cabo un control material riguroso para verificar la existencia real de los hechos y la proporcionalidad de las medidas. Sin embargo, también se detecta una tendencia a la deferencia judicial frente al ejecutivo que, en algunos casos, permite la ampliación de las medidas sin una revisión profunda, lo que plantea riesgos para la protección efectiva de los derechos humanos y la democracia. Se resalta la importancia del control judicial como mecanismo fundamental para evitar abusos y fortalecer el Estado constitucional de Derecho en contextos de emergencia y se lo destaca como elemento clave para balancear seguridad y derechos en tiempos de crisis. La investigación enfatiza la necesidad de un control activo y efectivo que garantice que las restricciones sean justificadas, proporcionales y fundamentadas, promoviendo así una democracia robusta incluso en situaciones excepcionales.
