Abstract

Es una convicción generalizada que no se puede conocer el derecho de un país leyendo simplemente sus leyes. Así mismo, que tampoco es suficiente consultar la doctrina elaborada a partir de estas últimas. Para lograrlo es indispensable saber cómo son aplicadas, en consecuencia interpretadas, por los diversos órganos encargados de aplicarlas y, en particular, por los órganos judiciales. Esto es debido a que los jueces, en la medida en que de manera constante y coherente justifican jurídicamente sus decisiones, otorgan un sentido determinado a las disposiciones legales. Estos criterios que van sedimentando constituyen la jurisprudencia, la misma que no debe ser comprendida como la simple suma de resoluciones judiciales. Cada una de estas es un pronunciamiento sobre un caso particular y los criterios aplicados solo deben ser generalizados, en tanto doctrina jurisprudencial, cuando son admitidos de manera regular por el órgano judicial correspondiente (por ejemplo, por la Corte Suprema). En países como el Perú, en donde las decisiones judiciales no son publicadas, resulta bastante difícil conocer la manera como son interpretadas y aplicadas las leyes. La publicación por particulares de compilaciones de sentencias o de textos legales anotados con resúmenes de resoluciones judiciales colma solo en parte este vacío. Estas obras cubren, como no podía ser de otra manera, algunos períodos y, cuando no se transcriben completamente las sentencias, la información dada se limita a la contenida en los resúmenes que terceros redactan como encabezamientos de las sentencias publicadas.
