Abstract

A primera vista puede parecer extraño que haya decidido detenerme en el estudio del ejercicio del derecho de retracto parental y de la situación que puede encarnar un fraus legis como es la datio in solutum ejercida como venta encubierta. No extraña ya tanto si tenemos en cuenta que la puesta en práctica del retractus de consanguíneos trata de salvaguardar la entidad y unidad del patrimonio parental.
