Abstract

Данная работа посвящена изучению вопросов, связанных с нормативно-правовым регулированием рецидивной деятельности, теоретических положениях данного вида преступления, мерах ответственности за совершения и возможностях дальнейшей эволюции в правовом регулировании данной темы. Задачи, которые решались в процессе исследования: 1. Анализ нормативно правовой базы, судебной и правоприменительной практики, законодательных инициатив в сфере рецидивной преступности 2. Выявление основных проблем в регулировании рецидивной преступности 3. Разработка положений, направленных на совершенствование законодательства и правоприменительной практики В результате исследования мной были разработаны предложения по развитию правового регулирования в сфере рецидивной преступности, предложены меры по устранению пробелов в законодательстве, позволяющие эффективно снижать количество рецидивных правонарушений.

This work is devoted to the study of issues related to the regulatory and legal regulation of recidivism, the theoretical provisions of this type of crime, measures of responsibility for the commission and the possibilities of further evolution in the legal regulation of this topic. Tasks that were solved during the research process: 1. Analysis of the regulatory framework, judicial and law enforcement practice, legislative initiatives in the field of recidivism 2. Identification of the main problems in the regulation of recidivism 3. Development of provisions aimed at improving legislation and law enforcement practice As a result of my research, I have developed proposals for the development of legal regulation in the field of recidivism, proposed measures to eliminate gaps in legislation that effectively reduce the number of recidivism offenses.
