Данная работа посвящена исследованию правового статуса личности в Китайской Народной Республике. Задачи, которые решались в ходе исследования: 1. Изучить основы правового статуса личности и роль конституции в его определении, его связь с правами и свободами человека и гражданина; 2. Описать исторический аспект развития института прав человека и гражданина в КНР; 3. Рассмотреть конституционное определение и регулирование правового статуса личности, основных прав и свобод в Китае; 4. Выявить проблемы реализации основных прав и свобод личности в КНРи разработать пути их решения. Методологическую основу исследования составили аналитические методики, системный подход, анализ источников, сравнительный анализ, сопоставление данных, сбор информации, а также систематизированные изучение источников. В результате были раскрыты основы правового статуса личности и его элементы, основные права человека и гражданина, правовой статус личности и особенности его регулирования в КНР, историческое развитие института прав человека и гражданина в КНР. Был выявлен ряд проблем, связанных с реализацией прав и свобод личности в КНР, а также с правовым регулированием прав и свобод иностранцев и лиц без гражданства.

This work is devoted to the study of the legal status of the personality in the People's Republic of China. The tasks that were solved during the study: 1. To study the basics of the legal status of the personality, in particular the role of the constitution in its definition, its relationship with the rights and freedoms of human and citizen; 2. Describe the historical aspect of the development of the institution of human and civil rights in the PRC; 3. Consider the constitutional definition and regulation of the legal status of an individual, fundamental rights and freedoms in China; 4. Identify the problems of the implementation of fundamental rights and freedoms of the individual in the PRC and develop ways to solve them. The methodological basis of the study was made up of analytical techniques, a systematic approach, analysis of sources, comparative analysis, comparison of data, collection of information, as well as systematic research of sources. As a result, we analyzed the foundations of the legal status of a personality and its elements, basic human and civil rights, the legal status of an individual and features of its regulation in the People's Republic of China, the historical development of the institution of human and civil rights in China. A number of problems were identified related to the implementation of individual rights and freedoms in the PRC, as well as to the legal regulation of the rights and freedoms of foreigners and stateless persons.
