Тема выпускной квалификационной работы: «Финансово-правовое регулирование в области валютных правоотношений». Данная работа посвящена исследованию проблематике валютных правоотношений, в частности валютного контроля и разработки методики их устранения. Задачи, которые решались в ходе исследования: 1. Изучение особенности истории возникновения валютных правоотношений 2. Выявление наиболее актуальных проблем встречающихся на сегодняшний день в этой сфере общественных отношений. 3. Исследование проблематики и анализ причины их возникновения. 4. Разработка рекомендаций по предотвращению и некоторых пробелов, встречающихся на сегодняшний день в российском законодательстве. Работа была проведена на базе Юридической Клиники СПБПУ, где собиралась значительная часть фактического материала: результаты анализа научных статей нормативно-правовых актов, которые регулируют данные правовые отношения и изучение научных статей, затрагивающих данную тему В качестве методологической основы настоящего исследования были применены такие методы, как формально-юридический, сравнительноправовой и метод анализа. В результате была рассмотрен осуществляемый контроль органами и агентами валютного контроля, применяющие инструмент власти для осуществления надзора над участниками валютных правоотношений, совершающих валютные операции . Разработаны законодательные инициативы по устранению проблем в области «репатриация выручки», «административная и уголовная ответственность за несоблюдение требований норм об отчетности» На основании проведенных исследований на Юридической Клинике СПБПУ было принято решение о либерализации некоторых положений Кодекса об Административных правонарушений, Уголовного Кодекса Российской Федерации и Федерального закона от 10.12.2003 «О валютном контроле и регулировании» N173-ФЗ.

Topic of the final qualification work "legal and financial management in the field of currency legal relationship". This work is dedicated to the investigation of the problematic of currency legal relationship, particularly, of currency exchange regulation and of the development of the system of its elimination. The problems being solved within the investigation: 1. Examination of the peculiarity of the history of origins of currency legal relationship. 2. Definition of the problems of the highest current importance in this sphere of social relations. 3. Investigation of the problematic and analysis of the reason of their origin. 4. Development of the recommendations on the prevention of certain gaps existing in the current Russian legislation. The work was performed on the basis of the Juridical Clinic of Saint Petersburg Polytechnical University where the main part of the factual material was taken: the results of the analysis of the scientific articles of the regulatory legal acts regulating the given legal relationship and the examination of the scientific articles connected with this topic. As the methodological basis of the current investigation the following methods were applied: technical, comparative-legal and analysis technique. As a result there was examined the control exercised by the authorities and the agents of currency exchange regulation, that apply the instrument of power fur supervising the participants of currency legal relationship carrying out currency operations. There were developed legislative initiatives on the elimination of the problems in the fields "profits repatriation" and "administrative and criminal responsibility for the violation of the requirements of the reporting norms". Basing on the results of the investigation performed in the Juridical Clinic of Saint Petersburg Polytechnical University there was made a decision to liberalize certain clauses of the Code of Administrative Violations, the Criminal Code of the Russian Federation and the Federal law of December 10, 2003 "On currency exchange control and regulation" N173-ФЗ.
