Abstract

Работа посвящена анализу используемых русскоязычными адвокатами и государственными обвинителями вербальных средств и анализу речевых стратегий и тактик в судебном заседании. В работе рассмотрен ряд вопросов, который лежит на стыке нескольких дисциплин (юридическая лингвистика, психология, риторика, лингвистическая экспертиза). Приведена трактовка терминов дискурс, юридический дискурс и судебный дискурс, рассмотрен институциональный формат судебного дискурса и его лексические и структурно-семантические характеристики. Проведен анализ речевых стратегий, реализуемых адвокатами и государственными обвинителями в условиях борьбы интересов, обусловленной разными коммуникативными задачами в рамках судебного разбирательства. Доказано, что базовая стратегия юридического дискурса относится к семантической стратегии убеждения, а вспомогательными являются прагматические и риторические. Соотношение основных и вспомогательных стратегий зависит от этапа юридической коммуникации.

The work focuses on the analysis of speech strategies and tactics used by lawyers (Russian-speaking defense attorneys and public prosecutors) in the Court of Law. The work dwells upon the set of questions related to several disciplines, such as forensic linguistics, psychology, rhetoric, linguistic expertise, etc. Interpretation of the terms discourse, legal discourse and forensic discourse is given. Legal discourse and its lexical, structural and semantic features are reviewed. The analysis of the speech strategies frequently used by defense attorneys and public prosecutors during the legal proceedings is carried out. It is shown that the basic strategy lo the legal discourse is the semantic strategy, while pragmatic and rhetorical ones are auxiliary. The ratio of the main and auxiliary strategies depends on an exact stage of legal communication.
