Abstract

Celem artykułu jest wskazanie ekonomicznych i prawnych aspektów zadośćuczynienia za błędy medyczne. Kons ekwencje błędów medycznych wiążą się z jednej strony ze skutkami zdrowotnymi dla pacjenta, który w wyniku błędu medycz- nego może wymagać długotrwałego leczenia lub rehabilitacji w ramach powrotu do zdrowia, może tego zdrowia nigdy nie odzyskać bądź stracić życie. Z drugiej strony dotyczą one osób, lekarzy i personelu medycznego, które dopuściły się tego rodzaju błędów, oraz podmiotów, zarówno publicznych jak i prywatnych, w których zdarzenie miało miejsce. Istotna jest zatem sfera zakresu i rodzaju odpowiedzialności, która nieodłącznie jest związana z rynkiem świadczeń ubezpieczeniowych oraz problemem finansowania systemu służby ochrony zdrowia.
